Terms and Conditions of the South Western Railway and De Vere Promotion (the “Promotion”)

1. The Promoter is South Western Railway Ltd (“SWR”, “we” or “us”) a company established in the UK with a registered office address at 4th Floor, South Bank Central, 30 Stamford Street, London, SE1 9LQ. Registered in England and Wales, company number: 03266760b.

2. Promotional Period: The Promotion commences at 11:00 am (BST) on Wednesday 21 October 2026 and ends at 23:59 PM (BST) on Wednesday 28 October 2026 (Promotional Period). All competition entries received after the Promotional Period are automatically disqualified.

3. Eligible Entrants: 
a. To be eligible to participate in the Promotion you must:

1. be a resident of the United Kingdom aged 18 years or over; 
2. have a UK postal address
3. not be employees of the Promoter or De Vere
4. Entry Method:
a. To enter the Promotion and be eligible to win the Prize, the Eligible Entrant must, during the Promotional Period:

• Follow @SW_Railway and @devere_hotels on Instagram
• Like the competition post on the Promoter’s Instagram account
• Comment on the competition post by tagging at least one Instagram account of the person they would like to bring on their next rail adventure
• Each valid comment counts as one entry. Multiple entries are permitted, provided each comment tags a different Instagram account. Use of multiple fake accounts or automated/bulk entries are prohibited. For the avoidance of doubt, a “valid comment” must contain at least one Instagram handle of another user, tagged using the @ format and must otherwise comply with these Terms.
• Entries submitted via Instagram stories, Direct Messages or any other method will not be accepted
• Entrants’ profiles do not need to be public but the entrant must be contactable via Instagram Direct Message (DM) and be able to be tagged on Instagram. For the avoidance of doubt, Entrants must ensure their Instagram settings allow them to receive DMs from the Promoter. If the Promoter is unable to contact a selected Winner or Runner Up because the entrant’s DM settings prevent receipt of messages or if the entrant does not respond to a DM request within the timeframe specified in these Terms and Conditions, the Promoter reserves the right to treat the entry as invalid and select an alternative Winner or Runner Up in accordance with Clause 10
• Abusive or inappropriate comments will automatically be disqualified
• By entering, Entrants agree to be bound by these Terms and Conditions including De Vere terms and conditions in respect of the Promotion and/or Prize Draw via the following link: https://www.devere.co.uk/terms-use (Eligible Entry).   In case of conflict between these Terms and Conditions and the De Vere terms and conditions, these Terms and Conditions shall take precedence in respect of the Promotion and the Prize Draw provided always that the De Vere terms and conditions shall always take precedence in respect of any stay at a De Vere property.


5. Prize
There shall be one (1) winner (‘Winner’) of this competition.


The Winner 

• Win an overnight stay for a family with breakfast and dinner at De Vere Beaumont Estate, Windsor
• The prize is valid for up to 2 adults and 2 children and is non-transferrable
• South Western Railway will provide an authority to travel letter for the winners to use on SWR services only – for the outbound and return journeys. The winner must be photographic ID to present to SWR staff if required. 
• The winner is responsible for any expenses and arrangements not expressly included in the prize. Travel between Windsor Station and the venue is not included. Guests must arrange and cover the cost of their own onward travel between Windsor Station and the venue for both the outward and return journeys
• The Main Prize must be booked in advance and redeemed on or before 31 March 2027 subject to availability; Blackout dates apply.

6. Prize Draw
• All Eligible Entries will be included in the Prize Draw
• The Prize Draw will take place via a random draw carried out by a representative of the Promoter by no later than 4 November 23:59 2026 (BST) (Prize Draw Date). Winning is not contingent on being present at the Prize Draw
• The first Eligible Entry drawn will be the Winner of the Main Prize 
• We may announce the Winner’s first name and town/city publicly on South Western Railway and De Vere’s Instagram account


7. Winner Notification:
• The Winner will be notified by the Promoter by 4 November 23:59 2026 (BST)
• The Winner will be contacted via Instagram Direct Message (DM) from the Promoter’s official Instagram account
• The Winner of the prize will be required to provide an email address via Instagram Direct message to be forwarded to De Vere
• The Winner will also be announced publicly on the Promoter’s Instagram account in the comments section of the competition post and/or the Promoter’s Instagram story (in the event of a redraw, the Promoter will not publicly announce the redraw Winner)
• The Promoter reserves the right to request verification of the age and identity of the Winner and any other information relevant to entry into or participation in this Promotion. Verification is at the discretion of the Promoter, whose decision is final.

8. Prize Delivery: 
• Main Prize Delivery: The Main Prize is valid for redemption up until 31st March 2027 from the Winner notification date of 4 November 2026. The Main Prize details will be provided by email by De Vere

10. Redraw: 
• If the Main Prize remains unclaimed within 7 days after the Prize Draw Date, or if the Winner is unable to receive the Prize for any other reason (including but not limited to if the Winner is disqualified or in breach of the Terms and Conditions), the Promoter may select an alternative Winner via a random draw carried out by the Promoter,  subject to the approval of any necessary regulatory authority (Redraw)
• The winner of the Redraw will be notified in the same manner as set out in clause 7 above.
11. Personal Information:
• Personal information including the Eligible Entrant’s name, Instagram handle, and email address will be collected and used for the purpose of conducting this Promotion. This may require disclosure to third parties, including local regulatory authorities and the Promoter’s agents or third-party service providers, for the purpose of conducting the Promotion. Further, the Winner agrees to participate in any and all advertising, prize draw or other commercial activities relating to the prize draw and consents and agrees that their photograph, image, likeness and voice may be used by the Promoter in all related promotional activity in any media without any rights of prior approval or inspection. The winner consents that their personal data will be sent to De Vere and may be used for their respective promotional purposes, in addition the winner may be required to participate in promotional activities with each of those entities. (Purpose). By entering this Promotion, Eligible Entrants consent to the use of their personal information for the Purpose

• The Privacy Policy also provides further information on how the Promoter collects, stores, uses and discloses any personal information and how to contact the Promoter regarding personal information, including to update or withdraw consent for the use of personal information.
12. Social Media Disclaimer
This Promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram. By entering, Eligible Entrants release Instagram from any liability arising from or relating to this Promotion. Entrants acknowledge they are providing their information to the Promoter and not to Instagram. Instagram’s terms of use apply, available at https://help.instagram.com/179379842258600.

13. General:
• The Promoter’s decision is final and binding and no correspondence will be entered into, including in the event of a dispute relating to the Terms and Conditions
• Entries will be deemed void if illegitimate, forged, manipulated or tampered with in any way. The Promoter reserves the right to disqualify any individual who is involved in any way in interfering or tampering with the conduct of this Promotion or has breached any of these Terms and Conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion
• By participating in this Promotion, Eligible Entrants may submit or otherwise make available content including, without limitation, comments, images, videos, usernames, or other material (“User Generated Content”). Eligible Entrants warrant that:
(i) the User Generated Content is their own original work and does not infringe the rights (including copyright, privacy or publicity rights) of any third party;
(ii) the User Generated Content does not contain any material that is defamatory, obscene, offensive, threatening, discriminatory, illegal, or otherwise inappropriate; and
(iii) they have obtained all necessary permissions from any individuals featured in the User Generated Content.
• By submitting User Generated Content, Eligible Entrants grant the Promoter a worldwide, royalty free, non exclusive, transferable licence to use, reproduce, modify, publish, display and share such content for the purposes of administering the Promotion and for related promotional and marketing activities in any media, without further notice, review or approval
• The Promoter reserves the right to remove, reject or disqualify any User Generated Content in the Promoter’s sole discretion if it breaches these Terms and Conditions or is otherwise deemed inappropriate for the Promotion
• These Terms and Conditions do not exclude, restrict or limit your statutory rights in any way. However, to the maximum extent permitted by law, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, without limitation:
(i) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
(ii) any theft, unauthorised access or third party interference;
(iii) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
(iv) any variation in market value to that stated in these Terms and Conditions;
(v) incorrect information provided by the Eligible Entrant;
(vi) any circumstances beyond the reasonable control of the Promoter;
(vii) cancellation or any delay in the commencement of the Promotion; 
(viii) disqualification of the Eligible Entrant from participating in the Promotion;
(ix) any tax implications; or the Prize.
(x) any  matter or circumstance related to the Winner’s stay at the De Vere property.

• The Promoter is not responsible for any outages, downtime, interruptions or failures of third party platforms used to facilitate this Promotion (including but not limited to Instagram). This includes, without limitation delays, non delivery of posts, comments or messages, entries not visible to the Promoter due to account privacy settings or platform errors and any other platform related malfunction, error or technical issue beyond the Promoter’s reasonable control. Any such issues may result in an entry not being received, visible or considered valid
• No expenses incurred in connection with entry to or participation in the Promotion will be paid
• If, for any reason beyond the reasonable control of the Promoter, this Promotion is not capable of running as planned, the Promoter reserves the right in its sole discretion to take any action that may be available to it, and to cancel, terminate, modify or suspend the Promotion, unless to do so would be prohibited by law
• The Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or amend these Terms and Conditions at any time without notice and at any time, including when subject to any directions from a regulatory authority
• These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales and the Promoter and any entrants agree that the Courts of England and Wales, exclusively, shall settle disputes.
